A fifteen year old teenager Jacob Kinney was arrested and charged with the fatal shooting of Army Pfc. MarStratton Gordon, 23, on August 28, 2016 in Harriman, Tennessee. Pfc. MarStratton was in Tennessee on leave visiting his girlfriend at the time of the shooting. Pfc. MarStratton enlisted in the Army in November 2014 and was most recently assigned as a heavy truck driver with the 101st Sustainment Brigade at Fort Campbell, Kentucky. WATE reported that court documents allege Jacob Kinney shot Pfc. Gordon in the head with a .357 round after a fight broke out between Gordon and his girlfriend, Kinney’s sister. The documents say Jacob pointed the weapon at Pfc. Gordon and fired one round which hit him in the left cheek, killing him. Also reported was after the shooting, a judge ordered the teen to undergo an evaluation and treatment at a mental health facility to determine his competency and IQ. Jacob Kinney has been charged with delinquent second degree murder and the Roane County prosecutors announced that they will try him as an adult. His bond was set at $50,000. On November 7, 2018, a Tennessee judged ruled Jacob Kinney acted in self-defense and dismissed the reckless homicide charges.

Date: June 10, 2012 Victim: David Wintermyer, 47, retired US Marine Corps, veteran Offender: Spencer Newcomer, 42, employed (self-defense) Location: York, Pennsylvania Circumstances: Spencer Newcomer wouldn’t mow his grass because he wanted to be one with the land and mother nature on his down time, he owns the home his grandfather owned, lots of great memories, Greg Taylor lives next-door to Spencer, Dave Wintermyer inherited his father’s home and moved to the neighborhood on the other side of Spencer, Dave retired from the Marines after twenty years, his long tours overseas ended his marriage, Dave was very proud to be a Marine, he flew the American flag and the USMC flag proudly on his property, Dave wants to play the hero and help others, Spencer’s dad was a Marine too, he served four years, Spencer appreciated Dave’s service because of his dad’s experience, Dave got out of the Marine Corps but he didn’t give up leadership or Marine Corps values, he would do anything for anybody, Dave would clear everyone’s driveways when it snowed, he became the guardian of the street, Dave would look after people’s homes when they were gone, Spencer’s dogs started pooping on Dave’s lawn, Spencer denied that it was his dog, Greg said Spencer’s dogs pooped in his yard as well, the neighbors confirmed Spencer’s dogs did not stay in his yard, Spencer found Dave in his yard one day, Dave was burning brush in his yard and blasting music, Dave told Spencer he didn’t like his dogs, on another occasion Dave took Spencer’s ladder without his permission and Spencer confronted him about it, Dave thought he was Mayor of Yorkland, Greg got more and more obsessive with his property, Greg and Dave started ganging up on Spencer about his overgrown property, Dave mowed his lawn every week, Greg and Dave had disdain for Spencer’s yard, Dave asked Spencer countless times to keep his dogs off his lawn but Spencer brushed it off as if he didn’t care, Dave approached Spencer one day and told him he had enough of his dog’s pooping on his property, Dave told Spencer he was a Marine and he was not and he needed to respect that, he threatened Spencer, but Spencer didn’t appear to care that he was offending anyone or if his dogs were bothering Dave, Spencer became more wary of Dave’s behavior, it got stranger and stranger, neighbors thought Spencer’s shed was an eye sore and needed to be torn down, Dave was worried that termites would get into his backyard, Spencer didn’t think it was a big deal because no one could see it, Greg was anal and wanted everyone’s stuff to look like his, Greg and Dave acted like they owned the block, Spencer met Bonnie Henderson and eventually asked her to move in with him, she loved his untamed yard, she noticed some of the yards in the neighborhood were immaculate, Dave was angry about his weeds growing six feet tall, Greg hatched a plan with Dave and they reported Spencer to the township, they complained about the weeds in the backyard and the inspector told him he needed to cut down the weeds, he was fined $600, this was just the beginning of their campaign of harassment, someone knocked over Spencer’s woodpile in his backyard while they were not home, the township does not allow boats or jet skis on the property, both Dave and Greg got fined for this, Dave got angry at the town for enforcing the law about his jet skis, another neighbor got fined as well for having a boat in his yard, they thought Spencer was the one reporting them but he denied it, according to Spencer’s girlfriend, he doesn’t like confrontation, Dave started venting on social media about the situation, speaking in a threatening tone, ranting about government overreach, authorities deduced that he suffered from some form of PTSD based on his social media rantings, Dave’s ex-wife didn’t deny that Dave most likely had PTSD after multiple deployments, Dave ranted to Spencer about getting fined by the township, Greg and Dave targeted Spencer and constantly tried to stir things up in the neighborhood, someone flattened Spencer’s tire and vandalized his property, they wrote graffiti all over his windows, the behavior was getting worse and escalating, Spencer called the police to report the harassment, one night they discovered both of Spencer’s dogs were poisoned, they survived but this made Spencer angry, they were scared too, Spencer didn’t know who to trust, Greg wanted to talk to Spencer and Greg said things had gone too far, he said he wanted to live in peace, Greg told Spencer he had nothing to do with any of the vandalism and blamed it all on Dave, he threw Dave under the bus, Greg was instigating Dave to do more and take more action, he used Dave to fuel the fire, he was feeding Dave stuff so he would call the township, Dave wasn’t a bad guy but he had demons that he struggled with, it appeared Dave’s demons were winning the battle, he admitted on social media he couldn’t sleep, Dave’s ex-wife said people with PTSD have triggers, when those triggers happen, it takes them to a very different place, they react on those triggers in a lot of different ways, Dave glared at Spencer and girlfriend when they were in the backyard, Spencer started carrying a pistol because he feared for himself in his backyard, he was protecting himself and his property, he had a permit but never had an occasion to draw a weapon on anyone, things get worst when Bonnie’s rabbit was mutilated, Greg continued to gaslight Dave into taking action, it felt like an act of terrorism to Spencer, they said Spencer was weak, had no guts and the pair were closing in on him, Dave continued to threaten Spencer and his girlfriend and stared at them while they were in their backyard, Spencer didn’t know any way to engage Dave without it escalating to a violent confrontation, Spencer built a wood rack that couldn’t be tipped over, the pair came over and busted up the wood rack, Greg was constantly egging on Dave who had a more aggressive personality, Spencer decided to take action, he called the police and they said there was nothing they could do about it, it added fuel to the fire for Dave, Greg continued to gaslight Dave to take action including harming him if he showed up on their property, Spencer had no idea they were texting each other and egging each other on, Dave started screaming at Bonnie and told her he was going to force her to eat their own dog crap, he was enticing Spencer to come and fight him, Bonnie was fearful because Dave appeared unhinged, Greg watched everything from his property, the police believed their goal was to kill Spencer, Spencer was running late one day and Greg was trying to hold him up, Dave came at Spencer on the road, told him he was sick of his dogs, Spencer tried to diffuse the situation, Dave threatened to kill his dogs so Spencer stopped his vehicle to deal with the situation and protect his dogs and property, Spencer felt backed in a corner as Dave aggressively came at him, Spencer pulled his gun out to defend himself, Spencer saw rage and said Dave looked unhinged, Dave pulled out what looked like a pistol from his pocket and Spencer shot him four times in the chest, but it wasn’t a pistol, it was a cell phone, Spencer called 911 and explained the situation, Spencer was afraid Dave was going to kill him, Spencer was arrested by the police and he was charged with murder, Spencer was held in solitary confinement and waited nine months for a trial, the DA was considering the death penalty, but the defense subpoenaed Dave’s cell phone records and discovered a series of texts between Dave and Greg planning an attack on Spencer, Dave was planning on a confrontation, this new evidence helped the jury decide that Spencer was innocent, but Dave’s ex-wife said the jurors didn’t get to see the real side of Dave, Spencer returned to his home, Greg was never charged with any crime but neighbors believed he was 90% of the reason for all this, Spencer feels isolated by the community and said he regrets that it came to this, he didn’t want this to happen but he felt like he didn’t have a choice Disposition: Spencer Newcomer was found not guilty of manslaughter in March 2013

Army veteran and former Ranger Fernando Duarte was shot and killed in a casino parking lot in Miami, Florida on Christmas day, December 25, 2016, after winning a prize. According to police, there was an argument ensued and escalated in the parking lot before Duarte was murdered by two suspects who were later identified and arrested. Kenin Bailey and Mikey Lenard were both charged with first degree murder. But the prosecutors dropped the charges against them because the evidenced revealed that Fernando was the aggressor and the two killed him in self-defense.

“Thomas Twain, an Idaho man with a machete, kicked down the door of home of Kaila Gearhart and James Cvengros and attempted to attack the couple. Upon hearing the shocking sounds of the door coming off its hinges, Cvengros ran the front room, screamed at Twain to leave, and ultimately shot the intruder.
The Idaho machete attacker survived the gunshot wound, and faces up to 15 years in prison for the home invasion. Idaho prosecutors claimed that Thomas Twain’s years of military service meant that he was a danger to the public.”

ID Go: An argument about access to a disputed road puts two Lompico, California men at each other’s throats. Things progress from intimidation and property damage to a backhoe attack and, finally, one of the most shocking murders the area has ever seen. -Bonfire of Blood, Fear Thy Neighbor (S3, E9)
Coast Guard veteran Walter Stephens shot and killed Bob Hall in Lompico, California on November 20, 1998. After killing Bob, Walt burned and attempted to hide his body in a bonfire on his property. Bob’s co-workers grew concerned when Bob didn’t show up for his retirement party at work. They called the police and asked them to do a welfare check on Bob. In the course of the investigation, police learned from family members that if anything happened to Bob, they needed to talk to his neighbor Walter Stephens. Bob and Walter had been in a long standing neighborhood feud with one another over a property issue. When police went to visit Walter at his home, they found him tending a large fire. They questioned Walter about Bob’s disappearance but he denied having any knowledge or information useful to the missing persons investigation. Upon closer examination of the bonfire, the police observed what appeared to be human remains in the fire. Walter admitted to killing Bob and he was arrested.
Fellow neighbors always thought it would be the other way around, that Bob would kill Walter. Some believe Walter finally snapped. Bob’s family believed it was first degree murder. Facing a possible death sentence, Walter pleaded self-defense but the prosecutors believed otherwise after the forensic evidence was examined. Walter said he thought Bob had a weapon when he approached him late one night on his property but his gun told another story. Walter pistol whipped Bob with his gun and then shot him while he was helpless and down on the ground. Prosecutors argued it wasn’t self-defense, it was straight up murder. They believed Walter started that confrontation with Bob that night with the intent to kill. Walter Stephens was found guilty and sentenced to 40 years to life in prison for second degree murder. He got 14 years for the murder and another 25 years for use of weapon. Bob’s bones were burned and mostly disintegrated and his body was not recognizable. Detectives believe that had the police not discovered Bob’s remains in the fire, Walter Stephens may have got away with it.

Date: September 7, 2013 Victim: Laron Estes, 59, Army veteran, former industrial welder, disabled Offender: Donald Easley, 64, Army veteran (two tours), disabled Location: Kerby, Oregon (Josephine County) Circumstances: Laron collected junk & it annoyed neighbors, Laron cut down an apple tree for no reason, Donald killed his former neighbor, Laron’s dogs were barking all the time, Laron didn’t like cats in his vegetable garden, Donald put up lights for his mother’s safety but they were shining on Laron’s property & too bright, Laron put up plastic barrier to block light, Donald installed another light shining on Laron’s property, Donald started his diesel truck in the middle of the night and left it running for an hour or more, someone shot out Donald’s lights (they suspected Laron did it), Donald calls sheriff but Laron denies he shot out the lights, Donald had 13 security lights aimed at Laron’s windows and they couldn’t sleep, someone wounded two of Donald’s mom’s cats with pellet gun, Laron denies harming animals because he loves them, Donald called animal control about Laron’s dogs claiming Laron didn’t have licensing to breed dogs, Donald contacted media, animal control took some of the dogs & Laron was fined for ordnance violations, Laron could not breed the dogs anymore, Laron was described as unpredictable, others said Donald was the aggressor, Laron sprayed Donald’s mom with water and Donald threatened to kill Laron, Donald smeared Laron’s name in any way he could, Donald called the EPA about a polluted well on Laron’s property, Donald wouldn’t let Laron use his property to remove the debris from the well, someone removed a property stake from Laron’s land, surveyor told Laron about Kenneth Vaughn, Donald had same issues with Vaughn, they were both fighting over 3 or 4 feet of property, according to Donald’s mom, Kenneth stopped taking medications, Kenneth drew a gun on Donald and Donald shot him in self-defense, but some believe Donald was jealous of Kenneth and it was murder, Donald’s fence was on Laron’s property but he refused to move it, Laron started fearing for his life, some neighbors said Laron wasn’t a nice guy, Donald called the sheriff’s department over 200 times throughout the years, Donald told cops he hopes he never has to kill Laron, Laron received a letter from a psychiatrist at the local VA cautioning him that Donald threatened to kill him, VA advised him to contact the police immediately, Laron tried to get a restraining order with new information but the judge wouldn’t allow the letter from the VA due to rules of evidence, psychiatrist couldn’t be at hearing so restraining order was denied, Laron made a ‘murderer’ sign and it pointed to Donald’s property, Donald was very angry about the sign, Donald reached out to the media asking for help with Laron, local police still didn’t take any action, physical altercation occurred between Donald and Laron and Laron allegedly beat the crap out of him, attorney told Donald to get a restraining order and they were successful using elderly laws, police were concerned that someone was going to get hurt or killed, there was constant feuding, the restraining order amplified the fear and hatred between them, Donald started carrying a gun so he wouldn’t be beat up again, the cops said the threat was from both sides, they were both pointing guns at each other and making threats, Laron pulled Donald off a ladder while he was trying to poke holes in the privacy fence, Donald fired his gun at Laron, Laron’s family said Laron was on the ladder trying to tape up the holes in the fence, Donald claimed Laron was trespassing and called the police, Donald pointed his gun at him and as Laron was running from the scene, Donald fired his weapon twice and shot Laron once in the back, Laron bled out and died on his property, at trial Donald claimed self-defense after characterizing Laron as a bully. Disposition: Easley found guilty of murder, sentenced to 25 years to life in prison

Detectives arrested Donald Easley in Kerby Monday afternoon. The charges against Easley are murder and unlawful use of a firearm. Josephine County Chief Deputy District Attorney, Lisa Turner, says this is not a case of whodunnit? The man suspected of killing his neighbor was in court Tuesday & he’ll be staying behind bars for a while. It’s been two weeks since Laron Estes was shot & killed, and the arraignment helped family breath a sigh of relief. Donald Easley was in court, via video, where a judge denied bail.
