A young wife shot dead — her soldier husband pulled the trigger. Was it an accident or was it murder?

On Oct. 16, 2014, Danielle Nemetz, 19, was shot and killed by her husband Skylar Nemetz, 20, in their Lakewood, Wash., apartment. Neighbors placed two 911 calls after hearing a gunshot. Skylar was charged with murder, but his defense says it was an accident and that these 911 calls show a distraught and panicked husband, not a cold-blooded killer. -48 Hours

On Oct. 16 2014, Army soldier Skylar Nemetz was taken into custody after he shot and killed his wife, Danielle. He was recorded on camera just minutes after the shooting. Do his statements sound like the words of a distraught husband who accidentally shot his wife or do they sound like the words of a cold-blooded killer? -48 Hours

Skylar Nemetz is on trial for the shooting death of his wife, Danielle. Prosecutors accuse Skylar of killing Danielle in a jealous rage, but Skylar says it was a tragic accident. During jury deliberations, “48 Hours” correspondent Erin Moriarty talks with Skylar as he waits to hear their verdict. -48 Hours

Skylar’s actions speak louder than his words. “The strongest evidence, believe it or not, is what he does immediately after the fact.” Skylar didn’t call 911, a neighbor did. And there wasn’t a single drop of Danielle’s blood on him, a clear sign that he didn’t try to save or even comfort her says Deputy prosecuting attorney Jared Ausserer. “He doesn’t render aid. He never checks on his wife. If it was an accident, he’s going to drop the weapon immediately, run over, grab her, assess her. He doesn’t do that.” He [Skylar’s defense attorney] knows the challenge will be convincing 12 jurors that a highly skilled soldier with years of weapon’s training could make such a fatal mistake. Juror and retired Army soldier: “Never point the weapon in the direction of anybody and pull the trigger like that believing that it’s unloaded.” -48 Hours

Army Veteran Carlos Holcombe Kidnapped & Raped 12-Year-Old Girl in El Paso, Texas; Sentenced to Life Plus 20 Years in Prison, Sentences Served Concurrently (August 22, 2014)

holcombe-png
Carlos Holcombe, US Army Veteran

Army veteran Carlos Antonio Holcombe was accused of kidnapping a twelve year old child from a high school parking lot and raping her on August 22, 2014 in El Paso, Texas. He lured the little girl by asking her if she would help him move some boxes. He then pointed a gun at her back and forced her into his truck. He took her to his home, put duck tape over her eyes, bound her, and raped her. School cameras caught him in the act of the abduction and he was arrested by police the next day. He was indicted on one count of aggravated kidnapping and three counts of aggravated sexual assault of a child. According to reports, Holcombe served ten years in the US Army in support of Operation Desert Shield and was honorably discharged. He now claims he has Post Traumatic Stress Disorder (PTSD) yet has not received any treatment from the Department of Veterans Affairs. He used the PTSD defense claiming that he suffers from a disassociative disorder he developed after he was sexually abused as a child. He also used the temporary insanity defense, claiming he was drinking alcohol and smoking marijuana right before the incident. A psychologist testified that he examined Holcombe by giving him several psychological exams and the results of the exams showed that Holcombe was exaggerating or lying about his symptoms. Holcombe was found guilty by a jury of three counts of aggravated sexual assault of a child, and one count each of aggravated kidnapping and indecency with a child involving sexual contact. He was sentenced to life in prison on one count of aggravated kidnapping and 20 years in prison on a charge of indecency with a child involving sexual contact. The sentences will be served concurrently.

“You don’t get to claim you have PTSD and commit a rape.” -Prosecutor Alyssa Nava

Shannon O’Roark Griffin Murdered Estranged Husband’s Mistress V.A. Psychiatrist Dr. Irina Puscariu; Sentenced to 20 Years in Prison (January 13, 2012)

On January 13, 2012, Shannon O’Roark of Texas drove 250 miles to Missouri to kill her estranged husband’s mistress fourty-six year old Dr. Irina Puscariu. Shannon O’Roark Griffin was an aeronautical engineer who worked for NASA training astronauts until she experienced a seizure that put her on definite sick leave. Shannon’s husband was a Colonel in the Air Force who decided he wasn’t ready to retire. Shannon and Col. Roscoe Griffin had been living separately for quite some time and discussed divorce but it appeared Shannon did not want a divorce after twenty years of marriage. Meanwhile, Col. Griffin lost a fellow service member to suicide and it devastated him.

Col. Griffin began seeing Dr. Irina Puscariu, a Veterans Affairs psychiatrist, for help. The professional relationship evolved into a romantic relationship, which is strictly forbidden in the world of psychiatry. Dr. Puscariu put her own career at risk when she chose to date Col. Griffin. Shannon found out thru social media that her husband was seeing Dr. Puscariu when he posted a picture with Irina on Facebook. Col. Griffin also changed his relationship status to “it’s complicated” which to Shannon was rejection, and rejection was the trigger. Col. Roscoe Griffin had no idea what was in store for him when someone is dumped and dangerous.

Shannon may have felt like the post meant the last twenty years were horrible and now I am going to replace you. Shannon asked Col. Griffin to go to a counseling appointment with her one last time in an effort to save the relationship. It would be here she would learn her husband of twenty years loved Dr. Puscariu and wanted to continue to see her. After this counseling session is when Shannon decided to go to Missouri and kill Dr. Puscariu. She wanted to obliterate Dr. Puscariu from her life so the problem would go away. She drove 250 miles to Irina’ home in Missouri and shot and killed her four times in front of her own mother, the last shot was to her face.

Shannon then fled the scene back to Texas and was held in custody until she could be extradited back to Missouri for a murder charge. Shannon plead guilty to second degree murder to avoid a trial. She was sentenced to twenty years for second degree murder and twenty years for armed criminal action. Investigators noted that before this incident Shannon had zero criminal history or violent behavior, she didn’t even have a speeding ticket. But when she got rejected by her husband Col. Roscoe Griffin, it would be jealousy and revenge that would drive her to murder the woman who stole her life.

Marc Patrick O’Leary, U.S. Army

On August 11, 2008, Marc Patrick O’Leary raped an eighteen year old at knife point in Lynnwood, Washington. The 18 year old woman reported the rape to her local police department but they accused her of lying and she was charged with false reporting. In 2011, Marc O’Leary was arrested in Colorado for rape and consequently admitted to raping several women in Washington and Colorado. DNA, digital evidence, and O’Leary’s vehicle linked him physically to several rapes. As it turns out, there was evidence on a camera corroborating the 18 year old’s report of rape in 2008. Investigators learned the Lynnwood, Washington police didn’t believe the alleged victim of rape and she was indeed found guilty of false reporting and fined $500.

The victim sued the City of Lynnwood who refunded her $500 fine and settled out of court for $150,000. Marc O’Leary pleaded guilty to the rapes in Colorado and was sentenced to over 300 years in prison. ProPublica covered the story and highlighted the dangers of mishandling rape cases and not using the FBI national database created to help catch repeat offenders. ProPublica won a Pulitzer prize for their coverage of “An Unbelievable Story of Rape” with The Marshall Project. Maureen Maher of 48 Hours also did an investigation titled the “Hunted” and she went inside the mind of a serial rapist who was hunting his victims while two detectives were hunting him.

Cops can be protective about their cases, fearing that information could be leaked that would jeopardize their investigations. They often don’t know about, or fail to use, an FBI database created years ago to help catch repeat offenders. Between one-fourth to two-thirds of rapists are serial attackers, studies show. -ProPublica

Spc. Megan Touma, U.S. Army

Army Spc. Megan Touma, 23, and her unborn son were murdered on June 21, 2008. Megan was found dead in a hotel room a few days later. After a homicide investigation was initiated, investigators learned Touma had a forbidden relationship with fellow Army soldier Edgar Patino when she was stationed in Germany. Patino gave her an engagement ring and asked her to marry him; she did not know that he was married. Shortly after Patino left Germany, Megan learned that she was pregnant. She chose to transfer to Fort Bragg, North Carolina so she could be with Edgar Patino. According to Patino, he stopped by Megan’s hotel room to end the relationship. They apparently argued and in a fit of rage Patino strangled her to death. Megan was 7 months pregnant when Patino murdered her. On November 2, 2010 Edgar Patino pleaded guilty to second degree murder and was sentenced to 16-20 years in prison.
