DOD Releases Annual Report on Sexual Harassment & Violence at the Military Service Academies, Academic Program Year 2017-2018 (January 31, 2019)

Department of Defense“Today, the Department of Defense released the Annual Report on Sexual Harassment and Violence at the Military Service Academies, Academic Program Year 2017-2018…There were 117 reports of sexual assault received across all three academies. This is an increase of five from the prior academic program year, indicating confidence in response measures, however, surveyed measures of unwanted sexual contact and sexual harassment increased compared to rates last measured in 2016. Ex-Calif military prep administrator arrested for alleged sexual abuse of former students

Carlsbad police say 55-year-old Jeffrey Barton was taken into custody late Thursday and was booked for investigation of sexual assault. Barton was responsible for academic and residential programs at the Army and Navy Academy, a private college-prep academy that has more than 300 male cadets in grades seven through 12. He resigned earlier this year.

US NavyCommand Influence to Figure in Navy Rape Case

Congress didn’t waste any time weighing in on the case either. Sen. Kirsten Gillibrand, D-N.Y., served notice that she will cite the Naval Academy sexual assault case in her efforts to legislate a major overhaul of the Uniform Code of Military Justice to take away commanders’ authority to refer charges and overrule decisions in courts-martial.

“It is time to move the sole decision-making power over whether serious crimes go to trial from the chain of command into the hands of non-biased, professionally trained military prosecutors — where it belongs,” Gillibrand said.

Two ex-Navy football players to go on trial in rape case despite judge’s recommendation

The superintendent of the U.S. Naval Academy set aside the recommendation of a military judge Thursday and ordered two former Navy football players to face court-martial in the alleged sexual assault of a female midshipman, attorneys for the accused men said.

Joshua Tate, 21, of Nashville, will be tried on a charge of aggravated sexual assault, and Eric Graham, 21, of Eight Mile, Ala., will be tried on a charge of abusive sexual contact. Both are also charged with making false statements.

US Naval Academy InsigniaNaval Academy superintendent doesn’t have to recuse himself from sexual assault case

A federal judge on Monday denied an attempt to force the superintendent of the Naval Academy to recuse himself from a case of alleged sexual assault by three former Navy football players.

The victim of the alleged assault — a 21-year-old female midshipman — had filed a federal lawsuit seeking an injunction that would require the academy’s superintendent, Vice Adm. Michael H. Miller, to give up authority over the case. Miller is responsible for deciding whether the three accused midshipmen should face courts-martial, the military equivalent of trials.
