On October 10, 2008 Judilianna Lawrence, 19, was reported missing. On October 13 the body of Judilianna was discovered after Robert Marko led the police to her. After an investigation, it was learned that US Army soldier Robert Marko of Fort Carson lured the disabled teen on MySpace, raped, and murdered her. He was also accused of raping another teenager and threatening to kill her five days earlier. Marko was convicted of the rape and first degree murder of Judilianna in 2011 and sentenced to life without parole.
In July 2012, ex-Marine and police officer Robert McClain was sentenced to 20 years and four consecutive life terms for brutalizing his wife and her lover in an hours long attack on September 28, 2008 in Irvine, California. Once McClain learned of his wife’s affair, he asked her to introduce him to her new boyfriend because he wanted to meet the man who would be around his children. Unbeknownst to her, McClain brought knives and guns to the meeting so he could punish both victims because of their affair. According to his wife Summer Lang, McClain was extremely jealous, controlling and violent during the marriage. When he learned his wife wanted to divorce him after 12 years of marriage, he planned the attack on her and her lover, Michael Heflin. McClain was convicted of several felonies including rape, torture, and kidnapping. Although Michael Heflin survived the attacks, he was beaten and stabbed multiple times, resulting in permanent brain damage and other life long injuries. Summer was tortured, kidnapped, and raped but managed to escape after Robert McClain fell asleep.

The early morning hours of August 23, 2008 changed Army Special Forces soldier Sgt. 1st Class Kelly Stewart’s life forever. Stewart went out for a night of drinking and partying in Germany with some other soldiers. Stewart was approached by a woman, a German citizen, and they began to dance. An hour or so later, they would leave together to engage in a casual one night stand. The next morning they said their goodbyes and she gave Stewart her number. A couple months later, Stewart would learn from German police and the Army Criminal Investigation Division (CID) that he was being accused of sexual assault by this same woman. Three Days in August by Bob McCarty takes the reader step by step through Kelly Stewart’s military court proceedings in Germany in August 2009. This book reveals the reasons so many concerned citizens are fighting for military justice reform. Whether you believe he is guilty or not, Kelly Stewart was railroaded with collateral charges in this particular court martial. There was no evidence, no forensic testing, and no witnesses to prove guilt beyond a reasonable doubt yet Kelly Stewart paid the price for embarrassing the US Army in an international incident.
Kelly Stewart had a stellar career and zero history of any wrong-doing in his more then ten year career, including behavioral and criminal. But the military prosecutor would lead you to believe he was a violent rapist luring his one victim with manipulation, not force. You read the book and decide for yourself if Kelly Stewart fits the modus operandi of a would be predator. After watching the Netflix docuseries Making a Murderer and reading Kelly Stewart’s record of trial, it’s looking like we have a case of making a rapist. As with all investigations, this is a testament to the value of the right to remain silent whether talking to your Chain of Command or an investigator. Given the military’s track record with aggressive and ruthless tactics, silence will prevent them from twisting your statements into something they are not. Kelly Stewart may have committed adultery and he owned up to it but what if when questioned he had said nothing and denied even knowing her. It’s not his fault that he or any of our soldiers think they can trust the system only to learn that it will betray them. Nothing can stop us from educating our soldiers about their due process rights, the same rights protected by the very Constitution they are willing to die for.
On August 11, 2008, Marc Patrick O’Leary raped an eighteen year old at knife point in Lynnwood, Washington. The 18 year old woman reported the rape to her local police department but they accused her of lying and she was charged with false reporting. In 2011, Marc O’Leary was arrested in Colorado for rape and consequently admitted to raping several women in Washington and Colorado. DNA, digital evidence, and O’Leary’s vehicle linked him physically to several rapes. As it turns out, there was evidence on a camera corroborating the 18 year old’s report of rape in 2008. Investigators learned the Lynnwood, Washington police didn’t believe the alleged victim of rape and she was indeed found guilty of false reporting and fined $500.
The victim sued the City of Lynnwood who refunded her $500 fine and settled out of court for $150,000. Marc O’Leary pleaded guilty to the rapes in Colorado and was sentenced to over 300 years in prison. ProPublica covered the story and highlighted the dangers of mishandling rape cases and not using the FBI national database created to help catch repeat offenders. ProPublica won a Pulitzer prize for their coverage of “An Unbelievable Story of Rape” with The Marshall Project. Maureen Maher of 48 Hours also did an investigation titled the “Hunted” and she went inside the mind of a serial rapist who was hunting his victims while two detectives were hunting him.
Cops can be protective about their cases, fearing that information could be leaked that would jeopardize their investigations. They often don’t know about, or fail to use, an FBI database created years ago to help catch repeat offenders. The Department of Defense statistics are alarming – one in three women who join the US military will be sexually assaulted or raped by men in the military. The warnings to women should begin above the doors of the military recruiting stations, as that is where assaults on women in the military begin – before they are even recruited.
But, now, even more alarming, are deaths of women soldiers in Iraq and in the United States following rape. The military has characterized each death of women who were first sexually assaulted as deaths from “noncombat related injuries,” and then added “suicide.” Yet, the families of the women whom the military has declared to have committed suicide strongly dispute the findings and are calling for further investigations into the deaths of their daughters. Specific US Army units and certain US military bases in Iraq have an inordinate number of women soldiers who have died of “noncombat related injuries,” with several identified as “suicides.”
Ninety-four US military women have died in Iraq or during Operation Iraqi Freedom (OIF). Twelve US civilian women have been killed in OIF. Thirteen US military women have been killed in Afghanistan during Operation Enduring Freedom (OEF). Twelve US Civilian women have been killed in Afghanistan.
Of the 94 US military women who died in Iraq or in OIF, the military says 36 died from noncombat related injuries, which included vehicle accidents, illness, death by “natural causes” and self-inflicted gunshot wounds, or suicide. The military has declared the deaths of the Navy women in Bahrain, which were killed by a third sailor, as homicides. Five deaths have been labeled as suicides, but 15 more deaths occurred under extremely suspicious circumstances.
Eight women soldiers from Fort Hood, Texas, (six from the Fourth Infantry Division and two from the 1st Armored Cavalry Division) have died of “noncombat related injuries” on the same base, Camp Taji, and three were raped before their deaths. Two were raped immediately before their deaths and another raped prior to arriving in Iraq. Two military women have died of suspicious “noncombat related injuries” on Balad base, and one was raped before she died. Four deaths have been classified as “suicides.”
On April 10, 2008, Navy sailor Chris Shortt discovered his step-daughter Meghan Landowski stabbed to death in their Portsmouth, Virginia home. Meghan was 16 years old and from the looks of the crime scene, there was a struggle; Meghan fought back. Investigators learned the killer used a knife from the family’s kitchen. They found it in a gutter down the street. The police didn’t know who committed the murder but they believed it was personal and Meghan knew her attacker. Chris and Angie Shortt believed Robert Hickey killed Meghan and they called NCIS at Naval Station Norfolk to let them know what happened. NCIS questioned Hickey. Robert Hickey was a military officer who was on his way to the rank of Captain when he was accused of sexual assault by Meghan. Robert was a close friend of the family and NCIS believe he groomed Meghan for a sexual relationship. Meghan said Rob began touching her when she was 14 and by age 15, Meghan was having a sexual relationship with a 30-year-old man.
The family supported Meghan as she pressed charges against Robert but they learned from civilian investigators that Hickey’s crimes amounted to a misdemeanor in Virginia; he would spend 12 months maximum in prison. But Robert Hickey was a Navy sailor and subject to the Uniform Code of Military Justice. The Navy was investigating and planning to prosecute the case. When NCIS questioned Robert Hickey about Meghan’s murder, he invoked his right to silence. NCIS considered Hickey a person of interest because he had a lot to gain if Meghan died. Meghan feared Hickey because he had a lot to lose. But Hickey’s DNA didn’t match the DNA collected at the crime scene and NCIS had no proof that Hickey committed the crime. Nonetheless, Hickey was given an other than honorable discharge from Navy. The police also suspected Meghan’s high school friend Donald because they dated in the past but the DNA didn’t match him either. At least 80 people volunteered DNA. Investigators sent the DNA for further testing to determine the geographic ancestry identity and learned the DNA belonged to an African American.
This changed the direction of the investigation and detectives began looking for African Americans in Meghan’s life. One person who became a person of interest was a counselor at Norfolk Naval Station but this individual wouldn’t cooperate with the investigation. Five months after Meghan’s murder, every lead dried up and fear was building in the community. Then a community member planned a memorial walk to help generate new leads. It was at this point someone came forward with Robert Barnes’ name. Investigators learned Meghan and Barnes were on the same bus and both participated in an exclusive arts program at school. Robert played the violin and was on his way to becoming a success story. Robert was described as a nice guy who blended in; he was fully committed to his violin music. A friend suspected Robert liked Meghan and when she asked him, he admitted it. Detectives went to the school to speak to Robert Lee Barnes and asked for a DNA sample. Eventually he acquiesced and gave investigators a used piece of gum.
The DNA was tested and the crime scene investigators reported the DNA submitted by Robert Barnes actually belonged to a girl; the police needed to talk to Robert again. In this interview, Robert Barnes admitted he was in Meghan’s house on the day of the murder. He said he went to Meghan’s house and climbed through the window after no one answered the door. He said he walked into a crime in progress; the perpetrator was wearing a mask and holding Meghan at gun point. Robert said the masked man asked him to have sex with Meghan, asked him to stab Meghan, and cut him to leave his DNA at the scene. The police believed that Robert Barnes was making this all up and arrested him. Robert’s DNA matched the DNA at the crime scene. Given the mountain of evidence against him, Robert’s defense attorney asked for a plea deal. Robert Lee Barnes pleaded guilty to first degree murder, attempted rape, aggravated sexual battery, abduction, and statutory burglary. In return, Barnes will be eligible for early release from prison in 42 years. Meghan’s parents were relieved there would be no trial.
Army Spc. Keisha M. Morgan, 25, died of a non-combat related cause in Baghdad, Iraq on February 22, 2008. Spc. Morgan was supporting Operation Iraqi Freedom on behalf of the Division Special Troops Battalion, 4th Infantry Division at Fort Hood in Texas. Army investigators ruled her death a suicide by overdose of her military-dispensed prescription anti-depressants. The family suspects Keisha may have been raped and murdered.
“But Keisha had confided in her mother about a night when she was certain a fellow soldier had slipped something in her drink at a local bar. When she awoke the following morning–failing to remember how she left the bar and returned to barracks–the soldier was in her room. This same man was on base at the time of Keisha’s death, says her mother, recalling her daughter’s concern about this. A week later, a roommate found Keisha lying on the floor and couldn’t tell if she was sleeping. Keisha erupted in seizures and the roommate ran for help. Medics could not stabilize her and she passed away.” ~WomensENews (December 17, 2010)
Brianna Denison, 19, was abducted by former Marine James Biela in Reno, Nevada on January 20th, 2008. She was subsequently found raped and murdered. According to Joe Biela, James Biela once wore the uniform of a Marine but was kicked out of the service. James Biela was convicted of raping and strangling Brianna and sentenced to death in 2010. Brianna’s family fought for ‘Brianna’s Law’ in Nevada and it passed:
The bill mandates a DNA cheek-swab whenever a person is booked for a felony arrest. If the arrest is deemed legitimate, the DNA would be cross-referenced with DNA from other crime scenes to see if the arrestee was involved. The proposal is named after Brianna Denison who was raped and murdered by James Biela in Reno in 2008. Proponents believe such a law may have saved Denison because Biela had a prior felony arrest.
